THE DALY CLUB SUBSCRIPTION SERVICE TERMS AND CONDITIONS
Effective April 2nd, 2009
This document (the "Agreement") is a legal contract between you and John Daly BBQ.com (“we” or “us”) that governs your use of The Daly Club membership. The terms below will apply to you if you register for and use The Daly Club subscription service (the "Subscription Service").
NOTICE
John Daly BBQ.com may from time to time modify these terms and post a copy of the amended Agreement at http://www.johndalybbq.com/TheDalyClub/Terms. If you do not agree to (or cannot comply with) the Agreement as amended, your only remedy is to stop using the Service or, if applicable, cancel your Subscription Service subscription. You will be deemed to have accepted the Agreement as amended if you continue to use the Service after any amendments are posted.
DESCRIPTION OF SERVICE
The Service allows you to receive a 10% discount on all orders you place. For discount, login the site after initial registration. Your discount will automatically calculate at checkout.
REGISTRATION
To use the Service, you must register and provide required information, including your name, address, phone number and a valid email address ("Registration Data"). You agree to provide accurate Registration Data and to update your Registration Data as necessary to keep it accurate.
You agree that you will not allow others to use your username and password and you are solely responsible for maintaining the confidentiality and security of your account. You agree to notify John Daly BBQ.com immediately of any unauthorized use of your code and/or account. John Daly BBQ.com shall not be responsible for any losses arising out of the unauthorized use of your special code and/or account and you agree to indemnify and hold harmless John Daly BBQ.com, its partners, parents, subsidiaries, agents, affiliates and/or licensors, as applicable, for any improper, unauthorized or illegal uses of the same.

CHARGES / BILLING
You agree to pay for the membership that you purchase and John Daly BBQ.com will charge your billing payment method for any such payment(s). You are responsible for keeping your account secure and confidential and you will be responsible for any charges that are incurred by any person through your account. All charges will be billed to the billing payment method you designate when you first register for the membership. If any of your billing information changes, you must update that information in the "Manage Profile" section of the "Account Profile" area. If your credit card company updates your billing information for you by providing revised billing information to us for your existing account, we will use that information to continue to bill your existing account (for example, if you lost your credit card but maintained your Visa or MasterCard account with a new account number, Visa or MasterCard may automatically send us your new account number.)
FREE GIFTS UPON PURCHASE OF MEMBERSHIP
When you purchase membership, you will 3 gift items (1 (one) bottle of John Daly BBQ Sauce, 1 (one) bottle of John Daly BBQ Dry Rub, and 1 (one) jar of John Daly Salsa). Your gifts will be shipped, free of charge, within 30 days of purchasing your membership.
REFER 10 FRIENDS OR FAMILY MEMBERS
When you successfully refer 10 friends or family members and they purchase a membership, you will receive your package, shipped free of charge, within 30 days when the 10th person purchases a membership. You will receive a free package for every 10 friends or family members you refer. Friends or family members who purchase a membership must provide your username to receive credit for their membership. If the friend or family member does not provide your username, you will not receive credit for their purchased membership.
PRIVACY
For additional information regarding John Daly BBQ.com's use of information collected in connection with the Service, please refer to John Daly BBQ.com's Privacy Policy, a copy of which is available atwww.johndalybbq.com/Privacy and which is expressly made part of this Agreement.
MODIFICATIONS TO SERVICE
John Daly BBQ.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice to you, without any liability to you.
TERMINATION
John Daly BBQ.com may in its sole discretion terminate this Agreement or suspend your account at any time without notice to you in the event that you breach (or John Daly BBQ.com reasonably suspects that you have breached) any provision of this Agreement. If John Daly BBQ.com terminates this Agreement, or suspends your account for any of the reasons set forth in this paragraph, it shall have no liability or responsibility to you, and John Daly BBQ.com will not refund any amounts that you have previously paid.
You understand and agree that your cancellation of your account and Service membership is your sole right and remedy with respect to any dispute with John Daly BBQ.com.
CANCELLATION
To cancel your membership, visit www.johndalybbq.com/ContactUs, complete the fields and enter the word “Cancel” in the comment area. If you cancel your subscription, John Daly BBQ.com will not refund any remaining portion of your subscription fees. Cancellation will take effect immediately during which you deliver notice to John Daly BBQ.com.
